Purpose of Assessments
The Assessments levied by the Association shall be used exclusively for the purpose of promoting the recreation, health, safety, enjoyment and welfare of the residents in the Properties, and in particular for the improvement, reconstruction and maintenance of the Common Area, the Green Area and Perimeter Wall and Fence, and any other purpose reasonable, necessary or incidental to such purposes as determined by the Board of Directors.
Delinquent Accounts Information
If HOA Assessment Payments are received after June 30th, an Owner's account is considered delinquent.
Here are the following steps for delinquent accounts according to the Collection Policy Adopted in 2014:
Owner will receive notice that the Annual Assessments payment is late and considered delinquent if payment was not received by June 30th. Late fees and interest will begin to accrue each month on the account if not paid.
Notices will be sent in July, August, and September to inform the Owner of the deliniquent account and offer a Payment Plan.
Owners may enter into a legal Payment Plan option with the HOA in order to pay the Annual Assessments.
In October, if the account is still delinquent, the HOA Board may vote and direct the management company to send notice and filing of a lien against the property. Filing of the lien, and all fees associated with this action are applied to the Owner's account.
Once the lien is filed, the Board may at any time also consider and vote for Foreclosure proceedings against a property if the account remains unpaid and no legal Payment Plan has been formally engaged.
If the Owner pays the Assessments and all late fees and interest at any time, in full, or through a legal Payment Plan option, the Board may release the lien on the property. All legal fees to release the lien are applied to the Owner's account for payment.
If you have questions about the collection policy for delinquent accounts, please contact Veracity (contact information below) or the HOA president: presidentleha@gmail.com
